Validity

By purchasing something from the Wolk webshop, the buyer automatically engages in our “Service” and the buyer confirms that he/she has read these Terms of Service, including the additional terms and conditions and policies referenced herein and/or available by hyperlink, and agree with them. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Online store items

These Terms of Service, as well as any information on the site are the intellectual property of Studio 22 BV and are protected with trademarks. It is not allowed to use products, product photos and / or text from the website for commercial purposes unless written permission has been given by Studio 22 BV. Any infringement may result in legal actions.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

 Modifications

 The prices indicated on the Wolk Webshop are denominated in euros, are inclusive of Value Added Tax (VAT) and are exclusive of shipping costs. The shipping costs will be charged separately depending on the country the buyer lives in and are clearly communicated during checkout and here in our Shipping section. The total purchase price due will be indicated when the buyer has indicated his/her customer information, shipping address and shipping method, and can be reviewed before the order is confirmed.

 Depending on the country the buyer lives in, it is possible that extra Import Taxes, Custom Fees or possible toll fees can be charged upon arrival of his/her order. For more terms and information on additional charges, please refer to section 7.7.

 Delivery, Costs and extra charges

 We do our utmost to make sure the products are delivered as soon as possible at the delivery address the buyer provided with his/her order. Dates of delivery are therefore indicative.

Wolk Webshop can never be held responsible if the order is not delivered on time and we are not liable for any loss, liability, damage, cost or expense arising out of late delivery, to the extent permitted by law. Wolk Webshop is not responsible for orders that are lost by way of act of others, unforeseen circumstances or force majeure.

The orders are shipped with DPD, UPS  or DHL express. The parcel can be delivered directly to your home, office or service point. Since delivery attempts are normally done during the day, we recommend using your work address or a service point. You will recieve a confirmation email after placing your order with all the details of your delivery.

 When your package leaves the warehouse, you will be notified by DPD , UPS or DHL by email or SMS about when and where your package will be delivered. If the courier is unable to deliver, the courier will leave a card in your mailbox. Please note we are unable to deliver to post office boxes.

If an order cannot be delivered because of an incorrect address provided by the buyer or if the buyer is absent at the delivery time, then this is entirely the buyer’s responsibility. If the buyer is absent, the logistics partner will sometimes try to arrange a second delivery moment, deliver the order with one of the neighbours or at a parcel centre nearby. Some will even try a third delivery attempt. If the buyer is absent on the second or third delivery attempt, the logistics partner can deliver the order to a parcel centre or send the order back to Wolk Webshop. Wolk Webshop can never be held responsible or liable for delays or extra costs arising from the absence of the buyer. If the parcel cannot be delivered by our logistic partner, Wolk Webshop reserves the right to claim the shipping costs partially.

Shipping costs are calculated based on the products, packaging and the country the buyer lives in. For EU countries, the shipping costs are fixed, and the buyer can check the rates for their country in the overview on our Shipping Section or during checkout.

 Within the European Union, orders are shipped on a DDP (Delivery Duty Paid)basis, meaning that all taxes and duties are included in the final price.  Deliveries outside the European Union (except for the UK, US and Switzerland) have to pay extra Import Taxes, customs fees or possible toll fees, which can be charged upon arrival of the buyer’s order. In no way can Wolk Webshop be held responsible for compensation of any kind for these additional charges.

 Suppose the buyer has to pay additional import taxes, customs fees or possible toll fees. In that case, they agree and engage to pay the entire amount of these import taxes in time as indicated by the local logistics partner or local customs officer. If the buyer refuses to pay for these additional charges or fails to pay the entire amount in time for his order to get customs clearance, the order will be returned to Wolk Webshop. In this case, Wolk Webshop reserves the right to refund the amount of the order and shipping costs minus the charges of the import taxes of the return. In this case, the buyer will be informed by the customer service of Wolk Webshop with a detailed indication of these import charges.

 Returns

Wolk has a 30-day return policy (40 days in December). Any returns must be shipped/postmarked within 30 days of being received. To be eligible for a return, your item must be unused and in the same condition you received it. It must also be in the original packaging with the labels attached. To complete your return, we require a receipt or proof of purchase. Upon reception of the returned item, we control the goods before processing the refund or exchange. When there are stains on the garments, we will need to charge you a washing fee of 15 euros.

 Exceptions

Gift cards are not refundable.

 Return Shipping

 Within the EU, Return shipping is free. You will automatically receive a shipping label and instructions when you follow the return process on our website. When using our return service, you will be refunded in the event of theft or loss during delivery to our warehouse.

 For returns outside the European Union, customers must pay for the return shipping. Customers outside the EU are advised to purchase a return label from us and include the original invoice in the package. This will avoid any customs charges.

Exchanges

 Wolk offers free exchanges for different sizes or colours within 30 days of your purchase within the European Union. All exchanges are based on stock availability. Wolk covers both the return shipping cost and the replacement item's shipping.

 Customers must pay for the return shipping for exchanges outside the European Union. Customers outside the EU are advised to purchase a return label from us and include the original invoice in the package. This will avoid any customs charges.

Then contact your credit card company; it may take some time before your refund is officially posted. Next, contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and still have not received your refund, please get in touch with us at orders@wolk-antwerp.com.

 How do you return your purchase?

 Within the EU:

  1/ REGISTER YOUR RETURN

 Go to our return page and enter your postal number and order number, what items you’ll be returning and the reason for your return. In case of an exchange, please specify the size and colour of the desired replacement item(s). You will then get an email with a pre-paid return label that you can download and print.

 2/ PREPARE YOUR PACKAGE

Place the invoice and the item(s) you’d like to return in the original box (or other solid container). Seal it securely with tape and place the return label in an excellent visual place outside the box.

 3/ SEND IT BACK

 Depending on your return label, you can call for a pickup or drop it off at your nearest service point.

 For any shipping country, pre-paid return slips are only valid when returning from the same country the order was originally shipped to. Should you return your order from another country than the one it was sent to, please contact our customer care. Please ensure you return your package within seven days after receiving the label.

 Collected information

 If the buyer places an order on the Wolk webshop, their data will be included in the customer base of Wolk. The contact information the buyer provided is necessary to process and complete their order. The transmission of incorrect or false identity information is considered a breach of these Terms and Conditions. The buyer’s data is protected and will not be passed on to third parties except those necessary to complete the order and the database of Shopify in the US.

Privacy

We respect the privacy rights of our visitors and recognise the importance of protecting your personal information. We have adopted a Privacy Policy that guides how we collect, store and use the information you provide.

The personal information you forward to Wolk will only be used to fulfil orders, keep you updated and assure you the best service. Wolk will not allow third parties to see or use your details without your consent. You have the right to view your details upon request. If the information needs to be completed or corrected, you have the right to have the information corrected or deleted. If you wish to end your subscription to our newsletter, please click “Unsubscribe” in the email footer or email hello@wolk-antwerp.com.

 Cookies

Cookies are used on the site to improve your experience. As you navigate our site, your preferences are remembered by temporarily using “session” cookies. Cookies enable our systems to gather information about your browser and monitor your navigational patterns while browsing the site. Site users have the option to accept or turn off cookies through their browsers, as well as being notified when a cookie is to be activated. This enables you to reject usage of this cookie or erase the cookie at the end of your visit. If you choose to turn off your cookies or erase cookies, your user experience may be limited.

Products or services

Wolk has made every effort to display as accurately as possible the colours and images of our products that appear in the Wolk. We cannot guarantee that the display of any colour on the buyer’s computer monitor will be accurate.

Accuracy of billing and account information

Wolk reserves the right to refuse any order the buyer places with us, and we may, in our sole discretion, limit or cancel quantities purchased per person, household or order if we believe that the order placed by the buyer or someone using the name of the buyer is considered fraudulent. We, therefore, use Shopify’s built-in Risk Analysis tool to check the details of the buyer’s billing information using specific parameters. These restrictions may include orders placed by or under the same customer account credit card and charges using the same billing and shipping address. If Wolk changes or cancels an order, we attempt to notify the buyer by contacting the email and billing address/phone number provided when the order was made. Wolk reserves the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

The buyer agrees to provide current, complete and accurate purchase and account information for all purchases made on the Wolk. The buyer agrees to promptly update their account and other information so we can complete the buyer’s transactions and contact you as needed.

Payment

At the moment, Wolk supports the following Payment options:

  • PayPal
  • Credit Card: Visa, Mastercard
  • iDeal, Bancontact/Mister Cash
  • Sofort
  • Carte Bancaire
  • Wolk Gift Cards

The buyer’s order will be sent once Wolk receives the full payment.

Wolk is in no way responsible for any credit card fraud or identity theft of their respective holder. We reserve the right to cancel the buyer’s order and payment if we detect a high risk of fraud, as indicated by Shopify's risk analysis.

 Gift Cards/Discount Codes

 Gift Cards are valid two years after the purchase date of the Gift Card.

 The validity and value of a Gift Card or discount voucher purchased or granted in the Wolk webshop is always mentioned on the Gift Card.

 In case of Fraud, attempt to trick/scam or presumption of other illegal activities through the use of Gift Cards or discount vouchers, or when using the coupons in the Wolk, we reserve the right to cancel the buyer's order, demand another payment method and delete their account from the Wolk.

The amount of a Gift card can never be refunded on any other payment method or paid in cash.

 Errors, inaccuracies and omissions

Occasionally, information on our site or in the Service may contain typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Wolk reserves the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after the buyer has submitted their order).

Wolk has made every effort to display the colours and images of our products that appear at the Wolk as accurately as possible. We cannot guarantee that the buyer’s computer monitor's display of any colour will be accurate.

 Force Majeure

Studio 22 cannot be held liable for non-compliance of the Service due to force majeure.

“Force Majeure Event” shall mean any of the following, the occurrence of which makes the performance of the Service impossible, impracticable or unsafe: an act of God (including without limitation earthquake), inevitable accident, fire, strike or other labour dispute, war or threat of war, the act of public enemy, act of terrorism or threats thereof, riot or civil commotion, national state of emergency, enactment, rule, order or action of any government or governmental instrumentality, failure of technical facilities, epidemic (including a health epidemic), interruption in, or substantial delay or loss of, technical facilities, or failure or substantial delay of necessary transportation services, or any other event or condition beyond Wolk reasonable control, as applicable.

 Governing law

These Terms of Service and any separate agreements whereby Wolk provides the buyer Services shall be governed by and construed by the laws of Belgium but to the express exclusion of the applicability of the provisions of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980. In case of any dispute about or arising out of this agreement, the matter shall be submitted to the exclusive jurisdiction of the exclusive jurisdiction of the Antwerp District Court.

 The buyer can review the most current version of the Terms of Service at any time on this page.

Wolk reserves the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is the buyer’s responsibility to check our website periodically for changes. The buyer’s continued use of or access to our website or the Service after posting any changes to these Terms of Service constitutes acceptance of those changes.

 The invalidity or unenforceability of any particular provision of these Terms do not affect the other conditions hereof, and these terms shall be construed in all respects as if such invalid or unenforceable provision were omitted or modified by a court of competent jurisdiction in such a way as to make it valid and enforceable.
